  • Portfolio materials: Only retained with your explicit written consent as outlined in project contracts

2.8 Service Delivery

  • All services are delivered according to individually agreed-upon project contracts
  • Project specifications, timelines, and deliverables are defined in separate project agreements
  • We reserve the right to decline any project at our discretion

3. Intellectual Property

3.1 Website Content

  • All content on TaktForm's main website (taktform.com), including design elements, logos, text, and graphics, is protected by copyright and other intellectual property laws
  • Users may not copy, modify, or repurpose our original design elements, code, or content for their own use without explicit permission
  • We encourage sharing our website URL with potential clients, professional networks, design galleries, and industry platforms to help connect us with those who might benefit from our services

3.2 Blog Content

Content published in our blog posts is shared to benefit our readers and the broader community. Users are encouraged to:

  • The scope and nature of any public display of client work will be strictly limited to what is explicitly outlined in the written agreement
  • Client testimonials and identifying information (including names, titles, or company details) will only be published with express written permission from the client

4. Website Usage

4.1 Acceptable Use

6. Consumer Rights (EU Directive 2011/83/EU)

For EU consumers:

  • You have 14 days to withdraw from contracts (except custom design services)
  • Digital content contracts are excluded from withdrawal rights once delivery begins with your consent
  • Business clients are not covered by consumer protection legislation

7. Liability

7.1 Warranty Disclaimer

  • We commit to delivering all agreed-upon project deliverables as specified in the project contract
  • While we design and develop with the goal of enhancing our clients' business success, we cannot guarantee specific business outcomes such as increased sales, customer acquisition, market performance, or any other business-related metrics and commercial performance indicators
  • Our commitment is to professional excellence in design and development, but the ultimate business impact depends on the client's business operations, market conditions, and various other external factors beyond our control

7.2 Limitation of Liability

  • Due to the nature of digital design and development services, all payments made to TaktForm are non-refundable. Once deliverables are provided to the client, they retain perpetual usage rights as specified in the project contract, regardless of any subsequent disputes or dissatisfaction
  • TaktForm's liability for any claims, damages, or losses arising from our services, whether in contract, tort (including negligence), or under any other theory of liability, shall be strictly limited to addressing and rectifying the specific issue within the scope of the original project agreement
  • Under no circumstances will TaktForm be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of business opportunities, loss of data, damage to reputation, or loss of goodwill, even if TaktForm has been advised of the possibility of such damages
  • Force majeure events may affect project timelines and deliverables
